2. PROGRAM DESCRIPTION
Pathway Martial Arts SMS is the SMS text message program operated by Pathway Martial Arts, LLC. The program is used to send members, prospective members, and event registrants information related to Pathway Martial Arts, including class schedules and reminders, schedule changes and cancellations, account and billing notifications, event announcements, program updates, and responses to inquiries you initiate by text.
3. HOW TO OPT IN
You may opt in to receive SMS messages from us in any of the following ways:
• Submitting your mobile number through a form on our website at www.pathwayma.com and checking the box agreeing to receive text messages from Pathway Martial Arts.
• Providing your mobile number on a membership application, trial registration, or waiver and indicating your consent to receive text messages.
• Replying START or YES to a text from one of our published numbers.
• Providing verbal or written consent in person at our facility.By opting in, you agree to receive recurring automated SMS messages from Pathway Martial Arts at the mobile number you provided. Consent is not a condition of purchasing any goods or services.
4. MESSAGE FREQUENCY
Message frequency varies based on your relationship with us and the events you have signed up for. Most subscribers receive between 2 and 8 messages per month. Members who have opted in to class reminders may receive additional reminder messages on the days of their scheduled classes.
5. MESSAGE AND DATA RATES
Message and data rates may apply. Pathway Martial Arts does not charge any fee for the SMS program itself, but your wireless carrier may charge you for sending and receiving text messages and for any data usage involved. Check your wireless plan for details. Pathway Martial Arts is not responsible for charges from your wireless carrier.
6. HOW TO OPT OUT
To stop receiving text messages from us, reply STOP to any message you receive from us. You will receive a single confirmation message and no further messages will be sent to your number unless you opt in again.You may also opt out by emailing us at info@pathwayma.com with the subject line "SMS STOP" and including the mobile number to be unsubscribed. Please allow up to two business days for email-based opt-out requests to be processed.
7. HOW TO GET HELP
For help with this SMS program, reply HELP to any message and you will receive a reply with our contact information. You may also contact us directly using the information in Section 11 below.
8. SUPPORTED CARRIERS
This SMS program is available on the following major U.S. carriers, including but not limited to: AT&T, Verizon Wireless, T-Mobile, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, Cricket, and most other major carriers and MVNOs. Carriers are not liable for delayed or undelivered messages.
9. PRIVACY
Your privacy is important to us. We do not sell, rent, or share your mobile number, SMS opt-in data, or message content with third parties for their marketing purposes. We use your information only to deliver the messages you have requested and to maintain proof of consent as required by law and carrier rules. 10. ELIGIBILITY
You must be at least 18 years of age, or have the consent of a parent or legal guardian, to enroll in this SMS program. By opting in, you represent that the mobile number you provided belongs to you or that you are authorized to provide it and to receive messages on it.
11. CHANGES TO THESE TERMS
We may modify or cancel this SMS program or these Terms at any time. Material changes will be communicated by SMS or posted at www.pathwayma.com. Continued participation in the program after changes are posted constitutes acceptance of the updated Terms.
